Panaji, August 7: A certified copy of the report of the Justice V.K. Jadhav (Retd.) Commission of Inquiry into Land Grabbing, obtained by Rawloo Vaikunth Khalap through the Right to Information (RTI) Act from the Home Department, Government of Goa, has brought to light the Commission’s detailed findings in connection with FIR No. 177\/2020 of Pernem Police Station involving the alleged illegal sale and development of a large property at Dhargal.<\/em><\/strong><\/p>\n

The report pertains to the property known as “Kapni Voril Ghera”, forming part of Survey No. 481\/0 of Dhargal village, measuring approximately 1,48,800 square metres. According to the Commission, the property was originally jointly owned by late Vaikunth Shet Khalap and late Sadashiv Sakharam Natekar.<\/p>\n

The Commission records that after the death of Vaikunth Khalap, the names of his legal heirs were duly entered in the revenue records through Mutation Entry No. 27090. It further notes that the property continued to remain joint and undivided, giving equal rights to all co-owners.<\/p>\n

Allegations of systematic land grabbing<\/h3>\n

The report states that the complainant alleged that Jit Vinayak Arolkar, acting as the Power of Attorney holder of the legal heirs of late Sadashiv Sakharam Natekar, systematically carried out deceit, forgery and land grabbing by taking control of the property and carving it into nearly 200 plots between November 2013 and March 2018.<\/p>\n

According to the Commission, these plots were sold to various purchasers without obtaining the consent of the legal heirs of the other co-owner, allegedly resulting in transactions worth “25 to “30 crore or more.<\/p>\n

Contradictions in legal documents<\/h3>\n

One of the major findings highlighted in the report concerns contradictions between the Power of Attorney and the Sale Deeds.<\/p>\n

The Commission observed that while the Power of Attorney specifically described the executants as co-owners of the undivided property, the Sale Deeds subsequently executed by the attorney represented the vendors as the sole and exclusive owners of the entire property.<\/p>\n

The report also notes that the Sale Deeds referred to a Succession Deed dated May 9, 2006, claiming that the vendors had become exclusive owners of the property. However, after examining the records, the Commission observed that such a succession deed was not found to exist, raising serious questions about the basis on which exclusive ownership was claimed before purchasers and registration authorities.<\/p>\n

High Court observations cited<\/h3>\n

The Commission also relied upon observations made by the Bombay High Court at Goa while dismissing a petition seeking quashing of the FIR.<\/p>\n

The report notes that the High Court had observed that the allegations disclosed a prima facie case requiring investigation and had also recorded that the Sale Deeds projected the property as belonging exclusively to the Natekar family despite revenue records and the Power of Attorney indicating that it remained jointly owned.<\/p>\n

Evidence before the Commission<\/h3>\n

The report refers to affidavits filed by the complainant as well as the Investigating Officer attached to the SIT investigating land grabbing cases.<\/p>\n

According to the evidence summarised in the report, the investigating officer stated that:the property continued to remain jointly owned and undivided;approximately 200 plots had been created;Sale Deeds were executed without obtaining consent from all co-owners;facts regarding ownership were allegedly misrepresented in the Sale Deeds;purchasers were induced into believing that the vendors had exclusive ownership over the entire property.<\/p>\n

The Commission also recorded allegations that roads were constructed, electricity poles erected and pipelines laid within the property during the course of the alleged development.<\/p>\n

Rights of co-owners<\/h3>\n

The report reiterates the legal principle that every co-owner enjoys equal rights over jointly owned property and that no person can validly sell the entire property without the consent of all co-owners.<\/p>\n

It observed that the formation of nearly 200 plots and their sale appeared to have been undertaken without the approval of all persons having ownership rights in the property.<\/p>\n

Commission’s conclusion<\/h3>\n

After examining documentary evidence, affidavits, oral submissions and relevant court records, the Commission concluded that there was sufficient material to hold Mrs. Vidya Sadashiv Natekar alias Snehal Sadashiv Natekar, Mr. Sanjay Sadadhiv Natekar and Mr. Jit Vinayak Arolkar responsible for the offences alleged in FIR No. 177\/2020.<\/p>\n

The report, signed by Justice V.K. Jadhav (Retd.), Chairman of the Commission of Inquiry into Land Grabbing, is dated 26 October 2023.<\/p>\n

The findings have now come into the public domain after Rawloo Vaikunth Khalap obtained the certified copy of the Commission’s report from the Home Department under the RTI Act, revealing the Commission’s observations and conclusions in the high-profile Dhargal land dispute.<\/p>\n

Subsequently, in January 2025, the Supreme Court quashed the FIR only against Jit Vinayak Arolkar, while expressly leaving the civil dispute undecided.<\/p>","protected":false},"excerpt":{"rendered":"
