Panaji, October 25, 2026: Can two Indian citizens enjoy different rights of entry into casinos operating within the same State? More importantly, if the law expressly restricts casino entry to eligible tourists and the High Court has upheld that distinction, why is there no visible, transparent mechanism to ensure its effective implementation?<\/em><\/strong><\/p>\n

These questions have brought the enforcement of Goa’s casino regulations under scrutiny, particularly the restrictions prescribed under Section 13G of the Goa, Daman and Diu Public Gambling Act, 1976, as amended.<\/p>\n

Under the statutory framework, entry into designated casino gaming areas is restricted to eligible tourists holding the prescribed permit. The definition of a tourist excludes persons domiciled or permanently residing in Goa and requires the visitor to be at least 21 years old.<\/p>\n

The distinction effectively creates two categories of Indian citizens for casino entry: permanent residents of Goa, who are restricted, and eligible visitors from other states, who may enter subject to statutory requirements.<\/p>\n

High Court Upheld the Distinction<\/h3>\n

In October 2021, the Bombay High Court at Goa, in Shukr Sinai Usgaonkar v. State of Goa<\/em>, upheld the constitutional validity of the distinction.<\/p>\n

The Court rejected the challenge under Article 14 of the Constitution, accepting that the classification between permanent residents and visitors had a rational connection with the legislative objective of protecting local families from the social and financial consequences of easy and continuous access to gambling.<\/p>\n

However, the judgment raises an equally important question about enforcement.<\/p>\n

If the restriction was upheld to protect Goan residents, what concrete measures has the government introduced to ensure that the protection actually operates?<\/strong><\/p>\n

Where Is the Tourist-Permit Verification System?<\/h3>\n

The effectiveness of Section 13G depends upon a credible system for identifying eligible tourists, issuing permits and verifying them at casino entrances.<\/p>\n

How does a casino operator distinguish a permanent resident of Goa from a visitor arriving from Maharashtra, Karnataka or another Indian state? What documents establish whether an individual is domiciled or permanently residing in Goa? How is the duration and purpose of a visitor’s stay verified?<\/p>\n

More importantly, how many tourist permits have been issued, how many casino-entry inspections have been conducted, and how many violations have been detected?<\/p>\n

Without publicly available information on these matters, serious doubts remain about the effectiveness of the restrictions.<\/p>\n

There are allegations that casino operators admit visitors without adequate verification of tourist permits. Such allegations require independent investigation rather than administrative silence.<\/p>\n

Singapore Enforces Its Casino Entry Restrictions<\/h3>\n

Singapore offers an important comparison. Its citizens and permanent residents are required to pay a government-imposed entry levy before accessing licensed casinos, while foreign visitors are exempt.<\/p>\n

The system creates a measurable and enforceable barrier intended to discourage frequent gambling among local residents.<\/p>\n

Several other Asian jurisdictions also impose nationality- or residency-based restrictions on casino entry.<\/p>\n

Goa has adopted a different approach by legally distinguishing permanent residents from eligible tourists. However, the crucial issue is whether this distinction is being enforced consistently.<\/p>\n

Law Cannot Remain on Paper<\/h3>\n

Gambling falls within the legislative competence of states under the Indian Constitution. Different states may therefore adopt different regulatory approaches, subject to constitutional limitations.<\/p>\n

The issue in Goa is not merely whether the distinction between residents and visitors is constitutionally permissible. The High Court has already upheld the challenged classification.<\/p>\n

The real question is whether the State Government is fulfilling the regulatory responsibilities arising from that law.<\/p>\n

If the objective is to protect Goan families from gambling-related addiction, indebtedness and social harm, effective implementation of the tourist-permit system is essential.<\/p>\n

If the government believes that the existing restrictions are impractical or no longer justified, it should initiate a transparent legislative review rather than allow uncertainty over enforcement to continue.<\/p>\n

The government must disclose the number of tourist permits issued, the procedure followed for verifying casino visitors, the inspections conducted and the action taken against violations.<\/p>\n

The Gaming Commissioner, police authorities and the departments responsible for casino regulation must also clarify their respective roles in implementing the statutory restrictions.<\/p>\n

A court-upheld law cannot be treated as optional merely because its enforcement may inconvenience a commercially powerful industry.<\/strong><\/p>\n

The High Court has upheld the legal distinction. The legislature has provided the regulatory framework. It is now for the executive to demonstrate that the law is being implemented.<\/p>","protected":false},"excerpt":{"rendered":"
