Bicholim, 25 September: The controversial large-scale development proposed at Karapur-Sarvan has encountered another significant legal hurdle, with the Court of the Civil Judge, Senior Division, Bicholim rejecting applications seeking dismissal of the civil suit filed by Hirabai Indurao Rane and others challenging rights over the property connected with the project.

The development assumes greater significance as work on the project has already been affected by a stop-work order issued by the Karapur-Sarvan Village Panchayat, while the historic agitation launched by villagers against the project has only been temporarily suspended following government intervention.

The civil litigation concerns land connected with the project being developed by the House of Abhinandan Lodha (HOABL)-linked developer. The suit names the developer, M/s Karapur Estates Pvt. Ltd. and others as defendants and challenges the chain of title through which rights over the property were transferred.

Karapur Estates has a political connection of considerable significance, with TCP Minister Vishwajit Pratapsingh Rane and MLA Deviya Vishwajit Rane listed as directors of the company.

Panchayat stop-work order already halted project

Even before the latest court development, the project had encountered a major hurdle at the local-government level.

The Karapur-Sarvan Village Panchayat issued a stop-work order concerning the project, bringing work to a halt pending resolution of the issues raised before the authorities.

The stop-work action came amid sustained opposition from local residents who had raised questions concerning land ownership, access, agricultural and tenanted land, hill cutting, environmental impact and permissions associated with the project.

The court development therefore comes at a crucial stage. On one side, the Panchayat’s stop-work action has affected development activity; on the other, the civil court proceedings concerning title and rights over the underlying property continue.

Historic Karapur agitation suspended — not withdrawn

The Karapur-Sarvan project had triggered one of the most sustained recent village-level movements over land and development in Goa.

Villagers continued their agitation for around 150 days, demanding scrutiny of the project and protection of their land and village.

Following intervention by Chief Minister Dr. Pramod Sawant, who directed the authorities to examine the villagers’ grievances, land records, ownership claims and the Panchayat’s stop-work action, the protesters decided to temporarily suspend their agitation.

The distinction is important: the agitation has been suspended, not withdrawn.

The villagers welcomed the government’s decision to initiate scrutiny of their grievances and gave the administration an opportunity to act. Their decision to suspend the protest was therefore seen as a temporary measure while awaiting concrete action from the authorities.

The latest civil court development now adds another dimension to the controversy at a time when the agitation remains suspended.

Hirabai Rane challenges chain of title

At the heart of the civil dispute is the contention of Hirabai Indurao Rane and the other plaintiffs that they possess rights and shares in the property and that the land could not have been exclusively conveyed in the manner claimed by the defendants.

The plaintiffs have challenged the chain of title through which the developer derives its rights from Karapur Estates.

Hirabai Rane has contended that Karapur Estates itself never purchased the property and therefore could not have passed valid title over the entire property to the developer.

The suit also raises questions concerning changes made in the survey records. The plaintiffs allege that Karapur Estates was not even incorporated on the date on which the relevant survey records were changed in its name.

These remain allegations and issues for determination by the court and should not be treated as final judicial findings.

Attempt to terminate suit fails

The defendants had sought dismissal of the proceedings at a preliminary stage. With those applications now rejected by the Civil Judge, Senior Division, Bicholim, the plaintiffs’ challenge survives.

Importantly, the rejection of the applications does not mean that the court has finally declared the plaintiffs to be owners of the property or invalidated the developer’s title.

It means that the title dispute has not been thrown out and will continue to be examined judicially.

This distinction is crucial because the property forms the foundation of a major real-estate development.

Three fronts now surround Karapur project

The project consequently finds itself confronted by three separate but interconnected developments — the Panchayat stop-work action, continuing civil litigation over property rights and the unresolved grievances behind the temporarily suspended villagers’ agitation.

For purchasers and investors, the continuing title litigation is also significant. Any rights created during the pendency of litigation may ultimately be affected by orders passed by the competent courts, depending upon the final outcome of the proceedings.

The fact that the suit has survived the attempt to dismiss it means that the competing claims over the land will have to continue through the judicial process.

For Karapur-Sarvan villagers, meanwhile, the court development comes while their agitation remains only temporarily suspended.

After months of protests, government intervention and the Panchayat’s stop-work action, the controversy has therefore not reached its conclusion.

The decisive questions concerning ownership, title and the legality of the competing claims over the land remain before the judicial and administrative authorities.
