Panaji, Aug 21: Congress leader Milind Prabhu has approached the Anti-Corruption Branch (ACB) and Directorate of Vigilance seeking an independent probe into alleged irregularities in Mutation Entry No. 1131 relating to properties at Karapur, while also seeking an investigation into the alleged role of Goa TCP Minister Vishwajit P. Rane and concerned revenue officials.

The complaint raises a key question: How was a property mutation application filed in the name of Karapur Estates Private Limited in September 1997 when the company was allegedly incorporated only in January 1998?

According to documents cited in the complaint, an application dated September 20, 1997 was submitted for mutation of properties bearing Survey Nos. 100/2, 90/1, 176/1 and 148/1 at Karapur. Prabhu alleges that the application was submitted or signed by Rane, purportedly in his capacity as a director of Karapur Estates Private Limited.

However, the Certificate of Incorporation cited by Prabhu shows that the company was incorporated only on January 1, 1998.

Prabhu has therefore urged the ACB to obtain the original records and determine how a company that allegedly had not yet been incorporated could have been entered in the government revenue records.

Rane’s alleged role under scanner

The complaint seeks verification of whether Rane submitted or authorised the September 20, 1997 application and whether he represented himself as a director or authorised representative of Karapur Estates before its incorporation.

The ACB has also been asked to examine whether Rane had any direct or indirect communication with revenue officials in connection with Mutation Entry No. 1131, whether any preferential procedure was adopted and whether any individual or entity obtained an undue property or financial benefit.

Prabhu has stressed that these are allegations requiring investigation and should not be treated as findings of guilt.

Revenue officials also face scrutiny

Prabhu has sought an investigation into the roles of the concerned Talathi, Mamlatdar and other supervisory revenue officials involved in processing and certifying the mutation.

The complaint seeks verification of how the application was accepted, whether the company’s legal existence was checked, what documents were relied upon and whether notices were issued to all concerned parties.

Investigators have also been asked to identify the officials who recommended and approved the mutation and determine whether any directions were received from senior officials, political figures or other influential persons.

Names allegedly replaced in revenue records

According to the complaint, Mutation Entry No. 1131 allegedly resulted in the deletion or replacement of names appearing in the Occupants Column, including Pratapsingh Rane, Fattesingh Rane and Rajsingh Rane, with the name of Karapur Estates Private Limited.

Prabhu has sought independent verification of the September 20, 1997 application, Form X dated September 22, Form XII dated October 10, the noting dated October 12 and Forms I and XIV relating to the concerned survey numbers.

He has specifically urged the authorities to secure the original records from government custody to rule out any subsequent alteration, substitution or manipulation.

Subsequent sale and 140-crore mortgage deal

The complaint further points to the subsequent transfer of properties, including Survey Nos. 148/0 and 176/1, from Karapur Estates Private Limited to Errichter Infra Private Limited through a registered transaction.

Prabhu has asked investigators to trace the subsequent property transactions and determine whether any allegedly irregular revenue record was relied upon to secure further property or financial benefits.

The complaint also flags a subsequent mortgage transaction involving Errichter Infra Private Limited.

According to Prabhu, the company created a mortgage/charge over properties including the concerned land in favour of Vistra ITCL (India) Limited, acting as debenture trustee. A Mortgage-cum-Charge Deed dated April 12, 2024, registered with the Dapoli Sub-Registrar under Serial No. 1647/2024, is stated to be connected with financial facilities of approximately 140 crore.

Prabhu has asked the ACB to examine whether the subsequent sale and mortgage transactions were in any way facilitated by revenue records originating from the allegedly irregular mutation process.

Civil suit pending before Bicholim court

The complaint also refers to Special Civil Suit No. 12/2025, pending before the Civil Judge, Senior Division, Bicholim.

Prabhu has clarified that he is neither an owner nor co-owner of the properties and is not a party to the ownership dispute or the civil suit. He said he was not asking the ACB to adjudicate the title dispute.

Instead, the complaint seeks an investigation into the conduct of public officials and private individuals in relation to government records and the mutation process.

FIR sought if cognisable offences emerge

Prabhu has sought an independent preliminary enquiry and investigation, seizure and preservation of original physical and electronic records, and recording of statements of the officials and private persons concerned.

He has urged the ACB to register an FIR and initiate appropriate criminal proceedings if cognisable offences emerge during the inquiry.

The complaint also seeks examination of possible offences involving false representation, forgery or fabrication of documents, manipulation of official records, criminal conspiracy, abuse of official position, unlawful gain and collusion between public servants and private parties.

Original records sought to be preserved

Prabhu has urged the authorities to immediately preserve the complete original file relating to Mutation Entry No. 1131, including the 1997 mutation application, Forms X and XII, the October 12 noting, Forms I and XIV before and after mutation, company incorporation documents, subsequent sale deeds, mortgage documents and relevant ROC/MCA records.

He has also requested that if any wrongdoing involving Rane is established, the findings be forwarded to the competent authorities for appropriate action in accordance with law.

Prabhu has reiterated that the allegations contained in his complaint are not a declaration of guilt against any person and that the documents and allegations should be independently verified by the investigating agency.

The complaint has also reportedly been forwarded to the Principal Secretary to the Prime Minister for information and appropriate action.
