Tourists cautioned against drunken driving, traffic violations and ignoring rental conditions; arrest and prosecution possible under Motor Vehicles Act.

Panaji, 10 October: Tourists visiting Goa and hiring self-drive cars must familiarise themselves with traffic laws and rental conditions to avoid police action, prosecution and unexpected financial liabilities.

 

While self-drive vehicles offer convenience, tourists should exercise due care before signing rental agreements and taking possession of vehicles.

Drunken and dangerous driving:

Under Section 184 of the Motor Vehicles Act, dangerous driving is punishable, while Section 185 specifically deals with driving under the influence of alcohol or drugs. Section 202 empowers police officers in uniform to arrest drivers without a warrant under specified circumstances involving these offences. Section 203 provides for breath tests, while Section 204 deals with laboratory tests, including blood tests, subject to statutory conditions. Drunken driving can attract a fine of ₹10,000 or imprisonment of up to six months, or both, for a first offence.

Important precautions for tourists:

Valid driving licence: Carry a valid driving licence and ensure the vehicle is hired from an authorised rental operator with proper registration, permits and insurance.

Traffic discipline: Avoid overspeeding, reckless driving, mobile-phone use while driving, signal jumping and other traffic violations. Wearing seat belts is mandatory.

Beach and off-road driving: Do not drive on beaches or in prohibited areas. Violations may invite police action.

Interstate travel: Check whether the rental agreement permits taking the vehicle outside Goa. Some operators impose substantial penalties for crossing state borders without permission.

Vehicle inspection: Record photographs and videos of the vehicle before accepting delivery to avoid disputes over existing scratches, dents or damage.

Accident liability: Immediately inform the police, where required, and the rental operator in case of an accident. Check contractual liability for repairs, insurance excess and charges during workshop repairs.

Rental charges and penalties: Read conditions concerning security deposits, late returns, tyre damage, scratches and traffic challans. Some agreements impose a minimum scratch charge of ₹3,500 and additional charges for delayed returns.

Authorised drivers only: Never permit an unlicensed or unauthorised person to drive the hired vehicle.

Tourists must understand that traffic offences can lead to criminal prosecution, while violations of rental agreements may result in financial claims or contractual disputes. Charges imposed by rental operators should not be confused with statutory government fines.

Visitors should also obtain receipts for all payments, clarify security-deposit refund conditions and retain a copy of the signed rental agreement.

A few minutes of precaution before hiring a vehicle can save tourists from police proceedings, heavy financial losses and unnecessary legal complications. Enjoy Goa responsibly, respect traffic laws and drive safely.
