PwD Reservation Rights Complaint: Gadekar Seeks Urgent Intervention from State Commissioner

Panaji, June 22: Social activist Atmaram D. Gadekar has submitted a reminder to the State Commissioner for Persons with Disabilities (PwD), urging immediate action on his complaint regarding the alleged denial of reservation benefits to Persons with Disabilities in a recruitment process of the Goa Legislature Secretariat.

In his reminder dated June 18, Gadekar referred to his earlier complaint submitted on June 15, 2026, and stated that no communication regarding any action taken has been received so far from the Commissioner’s office.

According to Gadekar, information obtained under the Right to Information (RTI) Act revealed that the recruitment process initiated by the Goa Legislature Secretariat through Advertisement No. LA/Admn/2024/1546 dated August 26, 2024, had not been completed and that the vacancies continued to remain live. He further claimed that the Post Based Roster supplied by the authority showed that Roster Point No. 1 was reserved for Persons with Disabilities under the Blindness and Low Vision category.

Gadekar stated that seeking protection of legal rights and equal opportunity is a fundamental right guaranteed under Articles 14 and 16 of the Constitution of India. He also maintained that it is the duty of citizens to bring to the notice of competent authorities any action that may adversely affect the implementation of welfare legislation and the rights of Persons with Disabilities.

In his representation, Gadekar emphasized that the State Commissioner for Persons with Disabilities has a statutory responsibility under the Rights of Persons with Disabilities Act, 2016, to safeguard and monitor the rights of PwDs and to inquire into complaints concerning deprivation of such rights.

He has requested the Commissioner to take immediate cognizance of his complaint, conduct an inquiry into the alleged violation of PwD reservation rights, call for recruitment records and roster registers from the Goa Legislature Secretariat, verify the status of the roster point reserved for the Blindness and Low Vision category, and issue appropriate directions to ensure compliance with the Rights of Persons with Disabilities Act, 2016.

Gadekar has also sought early communication regarding the action taken on his complaint and warned that, in the event of continued inaction, he would be compelled to pursue appropriate legal remedies before the competent forum for enforcement of his constitutional and statutory rights.
